Attorneys for actor Wesley Snipes will try to convince U.S. District Court Judge William Terrell Hodges as to why their client deserves a new trial.

Snipes’ defense team will argue the jury was biased.

According to the defense team, two jurors allegedly came forward in an e-mail that said three other jurors were convinced Snipes was guilty before the trial.

Teh 48-year old film actor has been free on bond while appealing his pending case for willfully failing to file federal tax returns.

If convicted the star will face up to three years in prison.

It is unsure if Snipes will be present during the proceedings.
